When he asked to borrow the car, they told him to be sure to be home by midnight. When his mother looked at the clock for the umpteenth time, it was 1:30. Shortly after that, the phone rang. He’d been stopped for speeding and they found marijuana in the car. Well, they’re really glad that he wasn’t in an accident, but he may wish he had been after they get him home. So what do they do next?
They remembered the name of a bail bond company that was near the jail. They called and someone said to come down, that it wouldn’t take very long to fill out the paperwork. Then he’d post the bond and get their son out of jail. The bail bondsman explained that it was similar to getting a loan. A state-regulated fee would be charged by the bondsman. The bond is surety to the court that their son would appear at court whenever he was scheduled to do so and the bond would be forfeited if he did not appear.
When a defendant ‘skips’, the bondsman attempts to find and rearrest the defendant. If possible, after rearrest, the bondsman will also attempt to schedule a new court date. The cosigners (the parents) are ultimately responsible for seeing that their son appears in court. They are also assuming the responsibility for paying off the bond if the case is not settled in court. The fee for the bond will not be returned at the conclusion of the case. However, if collateral was required, that would be returned, providing no other charges had been incurred, within 30 days of receipt of the final disposition paper being sent by the court.
